2. Cookie Policy

2.1 What Are Cookies?

When you visit our site, we store small files called cookies on your device to help the site run effectively, remember your preferences, and secure your transactions. This policy explains what these cookies do and how you can manage them.

2.2 How We Use Cookies

We categorize our cookies into four groups based on their purpose:

Squarespace Analytics: Built‑in analytics tools that show where traffic comes from and which art pieces are most popular.
Necessary: Essential for the site to function. They allow you to navigate and securely access your shopping cart.
Functional: Allow the site to remember choices you make, such as your preferred currency.
Analytics: Help us understand how visitors interact with the site so we can improve the experience.
Marketing: Used to track the effectiveness of our advertising and provide relevant updates.

2.3 Third-Party Disclosures & Technical List

Because we sell physical art, we use trusted third‑party providers who place cookies on your device to handle checkout logic and geometric shipping calculators:

Stripe & PayPal:
These cookies are essential for processing payments securely and preventing fraud. They must be active for checkout to function.

Squarespace Analytics:
Built‑in analytics tools that show where traffic comes from and which art pieces are most popular.

Detailed Cookie Audit:
For a full technical list of cookies used by our hosting platform, including duration and identifiers, see the
Official Squarespace Cookie List.

2.4 Your Rights & Consent (GDPR / UK GDPR)

If you are visiting from the EU or UK, you have specific rights under data protection law. We only place non‑essential cookies (Analytics and Marketing) after you provide explicit consent through our cookie banner.

Changing your preferences:
You may withdraw consent at any time by clearing your browser cookies or by clicking the “Manage Cookies” link in the site footer.

2.5 Cross‑Border Data Transfers

This website is hosted by Squarespace. Your data may be transferred to and stored in the United States or other countries outside the EEA. These transfers are safeguarded using standard contractual clauses and industry‑standard encryption.

3. Terms of Service

3.1 Introduction & Website Use

Welcome to our website. By accessing this site and purchasing our physical art products, you agree to comply with and be bound by the following Terms of Service. If you do not agree with any part of these terms, please do not use our store.

3.2 Intellectual Property Rights

All original artwork, physical prints, imagery, designs, and text available on this platform are the sole intellectual property of Kelly Herring.

Permitted Use:
Purchasing a physical piece of art grants you ownership of that specific physical item. It does not transfer any copyright or reproductive rights to you.

Prohibited Use:

No Image Reproduction: You may not copy, scan, digitally replicate, modify, or reproduce the artwork for any purpose without express written consent from the artist.
No Commercial Exploitation: You may not use Kelly Herring's art for commercial licensing, branding, promotional campaigns, or resale distribution networks.

3.3 Limitations of Liability & Material Care

Artwork is fragile and sensitive to environmental changes. We provide instructions for standard care, but we are not liable for damage resulting from improper handling, exposure to direct sunlight, moisture, or poor framing environments after delivery.

4. Shipping & Refunds

4.1 Order Processing & Handling

Every piece of art is carefully packaged using professional-grade, archival-safe materials to guarantee maximum structural protection during transit.

Handling Window:
Standard orders are processed, packed, and handed to the carrier within 3 to 5 business days. Custom framing or specialized packaging requirements may extend this timeline, in which case we will contact you directly.

4.2 Domestic Shipping (Within the United States)

We ship our original art and prints via trusted national carriers (USPS, FedEx, or UPS) with required signature collection upon delivery for high-value items.

Tracking & Insurance:
All domestic shipments include full third-party parcel insurance and real-time tracking numbers. Tracking codes will be automatically sent to your provided email address as soon as the label is generated.

4.3 International Shipping (Outside the United States)

We welcome international patrons and ship globally. However, cross-border fine art transport requires strict adherence to international shipping and custom protocols.

International Shipping Cost Adjustment Note:
To safely cover unpredictable global carrier surcharges, our international checkout rates are estimated at a flat tier. Once your artwork is safely packed and the exact postage label is purchased, we will automatically refund any overages directly back to your original payment method so you only pay the exact cost of transit.

Customs, Duties & Import Taxes:

Buyer Responsibility: The buyer is considered the Importer of Record. All international shipments may be subject to local import duties, customs taxes, value-added taxes (VAT), or brokerage clearing fees assessed by your destination country.
Separate Billing: These extra operational fees are not collected by us at checkout and are not factored into your shipping rate. You must settle these fees directly with your local customs authority or delivery courier to release your package.

Customs Enforcement Holds:
We accurately declare the full purchase value and exact Harmonized System (HS) code classification for original art on all commercial declarations. We are not responsible for transit delays stemming from routine international customs inspections or processing backlogs.

4.4 Return, Inventory & Refund Policy

Because physical art is unique and fragile, returns increase the likelihood of material degradation or loss during return transit.

Multi-Venue Availability & Prior Sale:
Original artworks and limited prints displayed on this website are concurrently offered for sale through external venues, galleries, and in-person exhibitions. While we make every effort to maintain real-time inventory updates across this platform, an item may occasionally sell through another channel before its status is reflected online.

We strongly encourage prospective buyers to contact us prior to checkout to confirm current availability. In the event an item is purchased that has already been sold elsewhere, and contact was not initiated prior to checkout, a refund will be promptly issued to the original payment method minus non-recoverable credit card processing fees.

Damaged Deliveries:
If your artwork arrives physically damaged from transit, you must notify us within 48 hours of delivery. Please provide clear photographic evidence of both the exterior packaging and the interior structural damage so we can file an immediate insurance claim with the carrier and coordinate a solution.

General Returns:
Except in cases of documented transit damage, all physical art sales are final. We encourage you to carefully review dimensions, scale, and coloration notes before completing checkout.
